These General Terms and Conditions of contract, hereinafter referred to as GTC, regulate the conditions of purchase of the various products offered for sale in the website www.ayamarnautico.com, property of Lorie Rosalyn Lightfoot, NIE X-2746974-S, owner of Ayamar Nautico, with business address Avenida de Andalucia 31, 21400 Ayamonte, Huelva, Spain.
Customers who make purchases at www.ayamarnautico.com fully accept the GTC as they appear at the time of purchase. The GTC must be read and accepted prior to purchasing any product from www.ayamarnautico.com.
Ayamar Nautico reserves the right to modify the GTC, at any time and without prior notice. The GTC will be accessible from the website at all times for the customer to consult or print at any time.
Only persons over the age of 18 are allowed to purchase products from www.ayamarnautico.com. Upon placing an order on the website, you guarantee us that you are over the age of 18.
The price of products is that displayed on our website (IVA included) except in the case of obvious error. Ayamar Nautico reserves the right to modify prices at any time but will always respect the price at the time of purchase.
We make every effort to ensure all the prices displayed are correct, however, errors can occur. If we discover an error in the price of the products you have ordered, we will inform you as quickly as possible and will give you the option to reconfirm your order with the correct price or cancel it. If we are unable to contact you, the order will be considered cancelled and we will fully refund any amount paid.
The purchasing procedure is very straight forward. If you haven't registered, you will need to register before being able to make a purchase.
Choose the desired products. Click "Add to Cart" to add them to the shopping basket. Once you have all the products you desire, the next step is to confirm the order and make payment.
Fill in or check the contact information, the order details, the delivery address or click "Free Local Pickup".
Check that all information is correct and click "Pay", the web will direct you to the website of our bank where you can pay securely. You will be returned to the website after making payment.
Once you have completed the order, we will send you an email listing the order details. If you notice an error in the delivery address or any other item of the order, you must notify us immediately by sending an email to email@example.com to rectify the error.
Please bear in mind that this does not mean your order has been accepted, it expresses an offer you make to us to purchase one or more products. All orders are subject to our acceptance and we will confirm our acceptance by sending an email stating the order has been dispatched. The purchase contract (Contract) between buyer and seller will be formalized only when we send confirmation of dispatch.
The Contract will only apply to the product(s) detailed in the email confirmation of dispatch. We will not be obliged to supply any other product(s) that may have been included in the order until we confirm they have been dispatched by a separate email.
The customer must make payment by credit card at the time of purchase.
At www.ayamarnautico.com we use our bank's gateway where you can make payment in their secure environment.
All orders are subject to availability and if we are unable to supply goods, we reserve the right to offer you information about alternative products.
The consumer/user has the right to cancel the contract within a period of 14 days from receiving the order without a reason and without incurring any costs other than the cost of returning the product(s) to us which is at the customer's expense.
In order to exercise these rights, you must notify us by emailing firstname.lastname@example.org advising us of your decision within the 14 day time period.
The cost of returning the product(s) is at the customer's expense except in the case of faulty goods or goods damaged in transport.
In the case of you exercising your cancellation rights, we will refund all monies paid (except initial delivery costs), with no penalties, within 14 days from the date you notify us of your decision. Nevertheless, we will not refund until we have received the goods.
We will not admit any requests to exercise your cancellation rights received after 14 days.
The following items, amongst others, are exempt (artículo 103 Real Decreto Legislativo 1/2007, de 16 de noviembre, por el que se aprueba el texto refundido de la Ley General para la Defensa de los Consumidores y Usuarios):
- The supply of custom-made or personalised goods.
- The supply of sealed goods which cannot be returned for health or hygiene reasons or where the seal has been broken after delivery.
Transfer of Risk and Ownership
Ayamar Nautico transfers all product risks to the customer upon delivery.
The customer aquires ownership of the goods when they have been paid in full, including all shipping costs or at the moment of delivery.
Shipping Costs and Delivery Times
We send goods to Spain and Portugal.
Except in extraordinary circumstances, we aim to ship your order the next business day.
If for some reason, we cannot meet the delivery date, we will notify you immediately and give you the option to go ahead with the purchase with a new delivery date or cancel and refund all monies paid.
All products offered in www.ayamarnautico.com come with the manufacturer's guarantee. The guarantee will not cover damage or imperfections caused by incorrect usage or manipulation of goods.

Instructions for returning goods in the case of customer cancellation
You may return goods to us by post or courier. The cost is at your expense. The delivery costs will not be refunded in any circumstance. Please bear in mind that if you decide to return items using payment on delivery, we are not obliged to accept delivery but if we do, we will deduct any associated costs from the amount refunded.
Please take into consideration that the item must be returned with its orginal packaging, instructions and any other documentation or packaging it was supplied with.
After inspecting the goods, we will advise you if you have the right to a refund. Any refunds due will be made as quickly as possible, within 14 days from the date you informed us of your decision to cancel, providing we have received the goods in our establishment. The refund will always be made to the card used to purchase the goods.
We will not refund any goods that are not in the same condition they were received in or that have been used beyond merely opening the product packaging.
In accordance with la Ley Orgánica 15/1999 de Protección de Datos de carácter personal, we inform you that any data you voluntarily provide us with at the time of purchase will be incorporated into a customer record card belonging to Ayamar Nautico, with the purpose of managing your purchase, shipment and after-sales service and customer service. We may also periodically send you information on product offers.
You have the right to access, amend, delete or oppose the data we hold at any time by emailing firstname.lastname@example.org
The information you provide us must be truthful and accurate.
In the case of receiving faulty or damaged goods, you must notify us immediately by emailing email@example.com and supplying your order number and a description of the damage suffered. Amounts paid for returned damaged or faulty goods will be refunded, including delivery charges and return postage costs up to an established limit. The refund will be made to the card used to purchase the goods. We will not accept returns in the following cases:
- The product is in poor condition
- The product is incomplete, missing accessories or has been manipulated or broken
- Accessories, instructions or other documentation are missing
- The 14 day period has expired or the proof of purchase or invoice is not supplied
The same exceptions to the cancellation rights are applicable to our returns policy. The following items may not be returned unless they are faulty:
- Electrical Equipment
- Custom orders
- Anodes, anchors, chain, hosepipe
- Outboard Engines
- Oils, paints, grease, liquids including any cleaning or general maintenance product
The refund will be made once we have received and inspected the product and found it to be in perfect condition (except in the case of faulty goods or goods damaged in transport) within 14 days of the customer receiving the order.
These GTC will be governed by Spanish law. Ayamar Nautico is subject to the Spanish Consumer & User rights, especially the articles that regulate Distance Selling.
